In October of 1919, the Department of Vermont established itself with a convention in Burlington to iron out the structure of the Department. There were 75 Posts in the Department with a total membership of 4,249 members. The internal structure of the Department was decided upon at the convention and a set of Constitution and Bylaws were produced as the groundwork of the Department. Thus was born the American Legion, Department of Vermont.

Headquarters for the State of Vermont was established in Middlebury, probably because that was closest to Commander Thomas, who was the President of Middlebury College. However, following the 1920 Department Convention was moved to Burlington because it was next to the Veterans Bureau.
